FlightAware Hits Kalshi With Suit Over Flight-Cancellation Markets

FlightAware sued Kalshi in New York federal court, alleging the prediction-market operator used its flight-tracking data and brand without authorization for contracts tied to flight cancellations. The complaint puts unauthorized data use and implied commercial association at the center of the dispute, as FlightAware says it never agreed to participate in Kalshi’s markets.

FlightAware alleges Kalshi presented contract outcomes as being verified through its data, creating the impression of a relationship between the companies. The lawsuit brings claims including breach of contract, trademark infringement and unfair competition, while the disputed market design turns proprietary aviation data into settlement infrastructure for event contracts.

The company is seeking temporary, preliminary and permanent injunctive relief aimed at stopping Kalshi from using its name and data in the contested markets. The case remains at an early stage, making judicial treatment of data rights and branding the next key test for flight-based prediction contracts.
